"Elon Musk’s company xAI has sued Minnesota over the state’s first-in-the-nation law banning “nudification” technology on websites and apps, potentially providing a test for how far states can go in constitutionally regulating the use of artificial intelligence.

Musk’s company sued on Monday in federal court, days before the law is set to take effect on Saturday and make Minnesota the first state to try to outlaw the increasingly proliferating technology that lets people use AI to create fake nude images of real people. The law was signed in May.

In the 38-page lawsuit, xAI – whose AI model chatbot and image generator Grok is available on the social media platform known as X, formerly Twitter, and elsewhere – said it does not contest the state’s interest in banning the distribution of AI-generated nude images of real people without their consent. But it said Minnesota’s law “extends far beyond that goal”, banning many constitutionally protected images and video and subjecting the company to a penalty of $500,000 for each violation."

The justice department’s lawsuit is part of a coordinated federal effort to reframe AI consumer protections as ideological overreach. In July 2025, Donald Trump signed an executive order on “preventing woke AI”, equating bias mitigation measures to a leftist “woke” agenda that suppresses free speech and truth. The federal National Policy Framework launched in March included a push to pre-empt state laws on AI, with Colorado’s law targeted. The justice department’s intervention in Colorado marks the first time the federal government has sought to intervene in a lawsuit challenging a state AI law."

On Friday, the Justice Department intervened in xAI’s challenge to Colorado’s “Consumer Protections for Artificial Intelligence” law. In its complaint, the DOJ argues the law’s provisions curbing algorithmic bias violates people’s 14th Amendment right to be treated equally under the law.

The intervention is in some ways an outgrowth of the movement to eradicate all race-conscious policies after the landmark Supreme Court case Students for Fair Admissions v. Harvard in 2023 struck down affirmative action in college admissions."

"A dispute between ChatGPT’s parent company, OpenAI, and one of the company’s founders – billionaire and tech entrepreneur Elon Musk – will play out in a federal court in Oakland, California, beginning April 27. 

Mr. Musk, who left the company in 2018, is suing OpenAI, claiming its leaders manipulated him into thinking he was contributing money to a nonprofit. He wants the company returned to its nonprofit status and seeks monetary compensation. 

OpenAI says Mr. Musk, who has since raised billions through the launch of his own for-profit company xAI, is misrepresenting facts to gain a competitive edge."

The complaint, filed Monday in the US District Court for the Northern District of California, claims Anthropic PBC, Google LLC, OpenAI Inc., Meta Platforms Inc., xAI Corp., and Perplexity AI Inc. committed a “deliberate act of theft.”

It is the first copyright lawsuit against xAI over its training process, and the first suit brought by authors against Perplexity...
